It's a Regular Holiday!!!

On Tuesday, April 9, 2013 is The Fall of Bataan aka. Araw ng Kagitingan. For more infos:  Here's the Proclamtion 459 signed by PNOY last August 16, 2012.

According to The Labor Code of the Philippines, Chapter III Article 94-Right to holiday

  1. Every worker shall be paid his regular daily wage during regular holidays, except in retail and service establishment regularly employing less than ten (10) workers)
  2. The employer may require an employee to work on holiday but such employees shall be paid a compensation equivalent to twice his regular rate

  1. Employee A is required to work on this regular holiday: his total income for the day would be: (Using NCR minimum wage rate basic pay = Php426.00 + COLA =Php30.00
Php 426.00 x 200%   =   Php 852.00

Mam, pano po kung papasok kami tapos pinag Oovertime pa kami?  Ok, balik tayo sa Art. 94 Right to Holiday - you will be paid an additional 100%  of your regular rate plus papasok ang Art. 87-Overtime Work - (excerpt) Work performed beyond  (8) eight hours on a holiday or rest day shall be paid an additional compensation equivalent to the rate of the first (8) eight hours on a holiday or rest day plus at least (30%) percent hereof. (meaning... pwedeng tumaas sa 30% depende sa employer nyo):

1.  Employee A will work on April 9, 2013. 7am to 7pm. ( Tuesday is his regular working day) ganito ang computation: as if php 456.00 ang per day nya:

Compute muna natin ang Overtime rate nya per hour:
(oopsss.. nde kasama ang COLA sa pag compute ng premium rate ha)

 per day                                    426.00 
 divided by 8 hours                             8 

 hourly rate                                  53.25 
 multiply by additional 30%              1.3 

 Overtime rate per hour            69.225   

So eto maswesweldo nya sa araw nato:

  7am to 4pm (regular time- Php 426.00  x 2)                 =       Php852.00
 4pm to 7pm (overtime - Php69.225 x 3 hours)               =           207.675

                                                                                          =  Php 1,059.675
  1. Mam, pano po yun? Rest day ko rin po pag tuesday, e pinapasok po ako ng 7am to 7pm,  Ok, papasok naman dito ang Art. 93Computation for rest day, sunday or holiday work - EXCERPT: Worker performed on any special holiday shall be paid an additional compensation of at least (30%) thirty percent of the regular wage of the employee.  Where such holiday work falls on employee's scheduled rest day, he shall be entitled to additional compensation of (50%) fifty percent of his regular holiday wage. at Art.. 87 ulit --Overtime Work - (excerpt) Work performed beyond  (8) eight hours on a holiday or rest day shall be paid an additional compensation equivalent to the rate of the firs(8) eight hours on a holiday or rest day plus at least (30%) percent hereof. (meaning... pwedeng tumaas sa 30% depende sa employer nyo):

1.  Employee B will work on April 9, 2013. 7am to 7pm. ( Tuesday is his rest day) ganito ang computation: as if Php 456.00 ang per day nya ulit:


Compute ulit natin ang Overtime rate nya per hour

 per day                                 Php  426.00 
 divided by 8 hours                                  8 

 hourly rate                                       53.25 
 multiply by additional 30%                 1.30

 Overtime rate per hour      Php    69.225



So eto ang dapat nyang masweldo sa araw nato:

  7am to 4pm (regular time- Php 426.00  x 300% )         =    Php1,278.00
 4pm to 7pm (overtime - Php69.225 x 3 hours)                 =         207.675

See? Malaki pala ano... kaya pasok na kahit holiday:-)

Note:  (Based on Labor Code of the Philippines- Employer may give higher Overtime rate)
